RULE 2.402  FACSIMILE TRANSMISSION OF DOCUMENTS

(1)  The clerk is authorized to accept the filing of pleadings and court documents by the use of facsimile (fax) communication equipment.  All filings shall be on 8 ½ by 11-inch standard paper.

(2) Documents which require a filing fee will not be accepted unless the filing fee and service fee are paid in full in advance.  In addition to the statutory filing fee, a fax service fee of $3 for the first page and $1 for each additional page shall be assessed.

(3) Documents will be received by the clerk between the hours of 8:00 a.m. and 4:00 p.m. Monday through Friday, except designated court holidays.  Documents received after 4:00 p.m. will be considered filed on the next following court business day.

(4) The clerk will establish a designated telephone number exclusively used for fax filings.  Further, the clerk will notify attorneys and litigants of any fax filing requirements.

(5) The maximum number of pages which may be sent to the court at one time is limited to twenty (20) pages except for pleadings.

(6) A cover sheet must accompany every transmission.  The following information must be included on the sheet: case name, case number (not applicable for new filings), document title, and the name and telephone number of the sender.  In the event the clerk accepts payments by credit card, the cover sheet shall also include the Visa or MasterCard number, expiration date of the card, and signature of the authorized agent for the card.

(7) SIGNATURE.  For purposes of MCR 2.114, a signature includes a signature transmitted by facsimile communication equipment.
