Criminal Procedure - Is a case is dismissed as to one co-defendant, is
it dismissed as to the other defendants?
Question
If you are a co-defendant and have not been picked up on a warrant and
the defendant has been to two court proceedings and the case was dismissed,
does that mean that it is also dismissed for the co-defendant? Will
the warrant be cleared from the system?
Answer
Just because a case is dismissed against one defendant does not mean the
case has been dismissed against other defendants. The warrant may
still be active. I would recommend that you contact the authorities
so that this matter can be resolved.
