Child Support - May child support be collected after the death of the payee?
Question
I have a friend that is in arrears of his child support and his ex-wife
just died. The children are 29 and 27 years old and living on their
own. Does he still have to pay the arrears on his child support?
Answer
Under policy, upon the death of a payee all arrears owed to that person
are removed from the Michigan Child Support Enforcement System after being
duly recorded. If there are no other arrears owed, the case is closed,
after the information is recorded. Any arrears owed to the
State of Michigan or any other public entity remain owing and are enforced.
This does not stop a representative of the deceased from attempting to
collect through other means.
