Annulment - If I reside in Georgia but was married in Michigan, where may I have my marriage annulled?

Question

I was wanting to find out about getting my marriage annulled.  I was married March 3rd of this year in an out of state marriage in Battle Creek.  However I live and I am a Georgia resident.  Can I get my marriage annulled up there or do I have to do it here in Georgia?

Answer

I believe that you would file in the State of Georgia since you are a resident of that State.  You did not mention whether your husband is also a resident of Georgia.  If he is a resident of Michigan, you may also file in the county in Michigan where he resides.  I would strongly recommend that you consult a local attorney to assist you with this matter.  Once the attorney knows all of the facts, he or she can advise you how to proceed.
