Child Support - Am I be responsible for medical bills that are incurred
after the age of 18?
Question
I have to pay 77% of my child's medical bills. My ex has all
of a sudden decided to get braces put on my 17 year old daughter.
The contract for these braces is going to be for 28 months. Am i
responsible for paying on this dental bill after the age of 18 since child
support will stop at 18. The payments will be 159.00 a month.
I will pay 77% of that which is almost all of it not to mention the large
amount of child support I have to pay on two children. It just does
not seem fair that I have to pay so much. My question is do I have
to pay this large dental bill after the age of 18?
Answer
As long as the services that are being rendered occur prior to the minor
child's 18th birthday (or grad from High School, which ever is later) the
costs are enforceable even though they are being paid beyond the age of
majority.
If you have joint legal custody of your daughter, the mother should
have consulted with you prior to entering into the contract.
