Probate - Must a person be nominated in a will to become personal representative?
Question
To become a personal representative does he/she have to be nominated.
He was not listed in the will.
Answer
An individual does not need to be nominated in a will to serve as a personal
representative. However, if an individual is nominated in the will,
the nomination establishes a priority for appointing the individual nominated
as personal representative.
