Probate - May an attorney acting as both attorney and personal representative charge fees for both capacities?

Question

If an attorney acted as attorney and personal representative, can he charge fees for both capacities?

Answer

An attorney may act as a personal representative.  However, he or she would need to keep careful records of the time spend for attorney functions and personal representative functions since such activities would be billed at different rates.
