Question
Your information on your web site says that the parents of an emancipated
minor are still somewhat obligated to support the emancipated child.
In what ways could they be obligated. If the emancipated child is
able to live on his own then what is the obligation of the parents exactly.
Is it insurance or clothes or what. Please reply. A very close
friend is going through the emancipation process please send this information.
Thank you for your time.
Answer
In Michigan emancipation is now for the benefit of the minor and not the
parents. The parents remain legally obligated to support an emancipated
minor the same as they would be for an unemancipated minor. Support would
be for the necessities of life such as food, clothing and shelter.
Emancipation assumes that a minor can and will take care of these item.
However, if the minor becomes unable to do so, the parents must provide
support. If this were to happen, the parents could petition the court
to rescind the emancipation because of changed circumstances.
You can read further information on emancipation in the pamphlet "Support
of Minors and Emancipation" which is found in the Court Library section
of the Calhoun County Courts web site. You can specifically find
this pamphlet at: http://courts.co.calhoun.mi.us/book002.htm
