Question
I have a friend who is in a bad situation in his home. He is 17 years
old and will turn 18 next February. He wanted to know if he, at 17,
has the right to choose where he lives without being emancipated. Also,
he wanted to know if his aunt, who is his guardian, could prevent him from
moving out. He has two places where he could go and the people would
be happy to have him. Please respond we would really like to know
the answer to these questions soon.
Answer
In Michigan, the parents of an unemancipated minor have custody and control
over the minor. A guardian appointed for the minor would also have
custody and control of the minor. This means that the parents or
an appointed guardian can legally make decisions as to where a minor may
live.
