How long does a misdemeanor arrest such as open intoxicant stay on your
police record ?
Answer
How long it stays on records at the police department would depend on departmental
policies. Court records would be permanent. It would only show
on LEIN or criminal history records if fingerprints were submitted, and
the record would be there permanently.
Abstracts are also sent to the Secretary of State and such convictions
appear on driving records. I believe they currently retain such charges
on driving records for 10 years.
