Durable Power of Attorney - When does the durable power of attorney become
invalid?
Question
When does the durable power of attorney become invalid. Is it effective
after death of the grantor?
Answer
In Michigan, authority under a durable power of attorney ends with the
death of the grantor. However, there are certain protections which
are provided for individuals who rely upon a durable power of attorney
if they are without knowledge of the death of grantor. Once the grantor
dies, the affairs of such decedent generally would be handled by the personal
representative of decedent's estate.
