Marriage - Is my spouse responsible for my debt upon marriage?
Question
Before I marry my fiancé, I want to be absolutely certain that he
could not be held responsible for my debts incurred prior to the marriage.
He is in Michigan, where we will live, and my debts incurred in another
state. Which state's laws would apply here? After some
real estate is sold, I plan to be debt free, but would rather not postpone
my marriage until then.
Answer
You new spouse will not become liable for your individual debts because
of the marriage. He would only become liable for such debts if he
agreed to become responsible for them.
