Adverse Possession - What are the requirements to claim adverse possession
on a property?
Question
What are the requirements to claim adverse possession on a property?
What can I do to prevent it? Do Michigan courts still hear cases
for adverse possession
Answer
Adverse possession is really a statute of limitations. The
title holder of a piece of property is prohibited from asserting his title
against someone who has claimed title to property after the period of limitations.
The title holder needs to assert title against the adverse possessor during
the appropriate period of time. Suits for trespass or quiet title
are often the remedy in court.
