Emancipation - May a child in foster care become emancipated?
Question
I am currently living with my grandfather in Flint. Neither one of
my parents are supporting me, but my mother does consent on me becoming
emancipated. My father basically has given up on me, and we are no
longer on talking terms. He now feels that I should "Do whatever
I want" as a means of him not caring about my actions anymore because of
my past. My grandfather now takes care of me, even though I still
see and talk to my mother frequently. The state pays him to take
care of me, so if the funds stopped coming , he would not be able to take
care of me. Can I still become emancipated with my mother's consent
because of her being my parent? Do I have to abide by my grandfather?
What are the rules of emancipation dealing with foster children?
Answer
Before you can become emancipated you would need to demonstrate your ability
to manage your financial affairs, including proof of employment or other
means of support. Public assistance would not be considered to be
"other means of support". Generally, you would need to be able to
show the court that you are able to be self supporting.
