When a child is waive to the adult system, what rights do the parents retain?
Can the parents request the child be returned to the family home if they
end up in court or jail?
Answer
The fact the juvenile is being treated as an adult in the criminal system
does not change his or her status as a minor in other areas. If the
juvenile were to be released or bond posted, in all likelihood the parents
would be the ones to whom the juvenile would be released. In short,
the parent's status is basically unchanged.
