Parental Waiver - What is the procedure and how long may it take?
Question
How long does it take to get a parental consent waiver? Do I have
to take a parent or just any adult?
Answer
If a parent is willing to permit a minor child to get an abortion, court
involvement is not necessary. A minor child may proceed on her own
and does not need an adult to be present. If the child is proceeding
through a "next friend", the next friend must not be disqualified by statute
and must be an adult. The court shall appoint an attorney if one
is requested. The hearing must be held within 72 hours of the filing
of the petition, excluding Sundays and holidays, unless the minor consents
to an adjournment.
