Emancipation - Should I be represented by an attorney?

Is it advisable and/or necessary to retain an attorney to assist with an emancipation petition?  Do most petitioners have the assistance of an attorney?

Answer

I believe it is always advisable to be assisted by an attorney when dealing with legal matters.  I believe it is not absolutely necessary.  Many courts will appoint an attorney for the minor.  Our court will appoint one if requested.  You can read more about this process in the Court Library section of this web site under "Support of Minors and Emancipation".  Specifically, this information is located at: http://courts.co.calhoun.mi.us/book002.htm
