Emancipation - My father who has my custody lives in Florida.  Can I be emancipated in Michigan since I am living here with my boyfriend?

I am a 16 year old female.  I am currently living with my boyfriend in the state of Michigan. I am financially covered as far as shelter, clothing, food and other health issues are concerned.  I have been here for a little over a month now.   I moved here from the state of Florida where my father lives.  He currently has legal custody over me but is no longer supporting me.  He is aware of me living here and has not objected.  If I get emancipated, will the courts allow me to be emancipated since I am financially, emotionally and mentally stable?   If so, since I am living in Michigan now, would I go about filing the petition here in Michigan or would I have to go through the courts in Florida?

Answer

I believe that you would need to file for emancipated in Florida since your legal residence would be that of your custodial parent.  It is possible that a Michigan court may allow you to file the petition with them.  I would suggest you contact the family court for the county in which you are living to determine if they would accept an emancipation petition from you under the circumstances.
