Minor - Can a minor lose their drivers license if they receive a ticket
for Minor in Possession?
Question
Can a minor lose their drivers license if they receive a ticket for Minor
in Possession (M I P)? This ticket was given to this minor at a house
party and had no alcohol on them and only blow a 0.01 on the breath test.
The cop told them that they were given this ticket because everyone at
the party was getting one. The cop also told her that she would lose
her drivers license. I feel this statement is wrong and they should
fight this ticket. They did not have alcohol on them and they were
not in their car. Please give me some advise on this issue.
Answer
The Secretary of State is required to suspend one's driver's license for
a conviction of minor in possession. You can read the statute at
www.michiganlegislature.org In the MCL section type in 436.1703.
