Question
Court order calls for visitation to take place on alternate weekends commencing
at 9:00 am on Saturday until 7:00 pm on Sunday, and Summer vacation as
follows: Summer 2006, no summer parenting time, "Summer 2007, two
weeks of the summer vacation period", etc. The order is not specific
to whether or not vacation time is to take place in consecutive weeks,
but because of the tender age of the child, (2 1/2 years old), it has been
agreed that one week will be used early summer and the remaining week to
be taken latter summer. Is the regular weekend visit counted as part
of the Summer Vacation- or is Summer Vacation in addition to the regular
alternating weekends? For example, can week one of the two weeks
of Summer Vacation time be used beginning on Sunday night directly following
a regular weekend visit through the following Saturday? Or would
the week one start at the beginning of the regular weekend visit?
Answer
Normally (unless the court order states otherwise) under the circumstances
you describe....if the week of parenting time begins following a regularly
scheduled weekend parenting time, the week would begin with the 9:00 Saturday
(weekend) parenting time and continue until the following Saturday morning.
If the week follows a non parenting time weekend, it would start at 7:00
on Sunday and end the following Sunday at 7:00 (which would be the end
of the alternate weekend of parenting time).
