Child Support - How does child support abatement work?
Question
I would like to know for sure how the 50% abatement works if I have my
kids only one week a month (overnights) in the summer? Does the 50%
abatement only happen for the week that I have the kids or do I get a 50%
reduction for the whole month even if I only have the kids for one week?
If it is true, what forms do I fill out when I have the kids for that week?
Do I fill out a new form for each week that I have them?
Answer
For each separate 6 or more overnight period, the 50% abatement would apply
(presuming that is what your order calls for). Therefore, you would
get the abatement for the one week per month in the summer that you have
the kids (presuming it is for at least 6 overnights consecutively).
You would need to either submit an abatement request for each individual
period of parenting time, or you could wait until the end of the summer
and put them all on one request (your request must specify the names of
the kids and the dates they were picked up and returned).
