Juvenile - What are a minor's rights upon arrest?
Question
I was wondering what the law is on interviewing a juvenile defendant before
arrest. Does a parent have to be present? If there is law on
it, where would I find such law?
Answer
I believe if a juvenile is not taken into custody and free to leave, he/she
would not have to answer any questions. If a juvenile is taken into
custody, in Michigan, a parent, guardian or custodian must be notified
immediately. The juvenile must also be given a Miranda warning, the
same as adults. I believe this is provided for in the Constitution
and case law.
