Child Support - If the minor child is living with the non custodial parent,
how may child support be abated?
Question
I am a non custodial parent but my daughter lives with me now. Can
I file a motion to reduce my child support to zero?
Answer
There is a process under the law now that allows the Friend of the Court
in your jurisdiction to abate your support if you are living full time
with the minor child. File a statement with that Office which will
allow them to follow their procedure for abatement. A motion is not
necessary for the support issue, however if you are considering asking
for a change in custody, a motion is required. You can do that by
retaining counsel of your choice, or your friend of the court office can
provide you with forms and instructions for a pro per filing.
