Mental Commitment - Are mental commitment files confidential?
Question
Can mental files be copied for a person asking for a copy of the file but
who has no relationship with the parties? What if the person who
is the subject of the petition asks for a copy? Our court is
not sure if they are open files or confidential.
Answer
My court has taken the position that mental files are public record as
are most other probate court files unless they have been specifically closed
by court order pursuant to the court rule which deals with closed files.
Copies can be obtained of such files according to the courts procedure
concerning copies.
