Criminal Procedure - What is the Holmes Youthful Trainee Act?
Question
I have recently been charged with a felony and my attorney said something
about the HUTA program. I'm not sure what the HUTA program is or what it
does. All I know is that it stands for Holmes Useful Training Act.
Can you please explain to me what it is? Id gladly appreciate your help.
Answer
Holmes Youthful Trainee Act is a diversionary program for defendants between
17 and 21. At the discretion of the judge an offender may be placed on
probation for a period of time and if the offender completes probation
the case will be dismissed without a conviction. Prison is available for
more serious offenses.
